SCOPE
These Terms and Conditions apply to courses and workshops offered by The Wooden Boat Centre Tasmania. By enrolling in a course and paying the required deposit, the participant agrees to these Terms and Conditions.
Course Categories
For the purpose of these Terms and Conditions, our courses are divided into two categories:
• Short Courses: courses with a duration of up to and including two weeks
• Extended Courses: with a duration of more than two weeks
Different cancellation and withdrawal conditions may apply to Short Courses and Extended Courses due to the greater planning, staffing and financial commitments associated with longer courses.
Where these Terms and Conditions refer to a Short Course or Extended Course, the above definitions apply.
Enrolment and deposit
A deposit of 10% of the total course fee is required to secure a place in a course.
Course places are limited. Once an enrolment is confirmed that place is reserved for the participant and may no longer be available to another prospective student.
The 10% deposit is therefore non-refundable if the participant cancels or withdraws from the course, except where otherwise required by Australian Consumer Law. The deposit contributes towards the administrative costs associated with processing the enrolment, managing course places and preparing for the course.
Payment of the deposit confirms acceptance of these Terms and Conditions.
PAYMENT OF FEES
The balance of the course fee must be paid by the due date advised by The Wooden Boat Centre.
If payment is not received by the due date, we may contact the participant to confirm whether they intend to proceed. If payment remains outstanding, we reserve the right to cancel the enrolment and offer the place to another participant.
cancellation by the participants - short courses
We understand that circumstances can change. Participants who are unable to attend should notify us as soon as possible.
For Short Courses, participants must provide at least 60 days' written notice before the advertised course commencement date to receive a refund of course fees paid, less the 10% non-refundable deposit.
Where a participant cancels their enrolment:
the 10% deposit is normally non-refundable;
any course fees paid above the deposit may be refunded where sufficient notice is provided and we are able to minimise the loss associated with the cancellation; and
cancellations made close to the commencement of a course may result in some or all of the course fee being retained where we are unable to fill the place or have already incurred costs in preparing for the participant.
We will consider each cancellation reasonably, taking into account the amount of notice provided, whether the place can be filled by another participant, and any costs already incurred by The Wooden Boat Centre.
cancellation by the participants - extended courses
Places in our Extended Courses, including the Full-Year Course are strictly limited and represent a significant commitment by both the participant and The Wooden Boat Centre.
Once a place is accepted, The Wooden Boat Centre reserves that position for the participant and may decline other applicants. The Centre also plans staffing, materials, workshop capacity and course activities based on confirmed enrolments.
A 10% non-refundable deposit is required to secure enrolment, except where a refund is required under Australian Consumer Law.
Participants wishing to withdraw from the Full-Year Course must notify The Wooden Boat Centre in writing at least 120 days before the advertised commencement date.
Where at least 120 days' notice is provided, course fees paid above the 10% deposit will be refunded.
Where less than 120 days' notice is provided, the participant may be responsible for additional course fees or costs reasonably incurred by The Wooden Boat Centre as a result of the withdrawal. In determining any amount retained or payable, we may take into account:
• the amount of notice provided;
• whether the vacated place can reasonably be offered to and filled by another participant;
• costs and commitments already incurred in preparation for the participant's enrolment; and
• the financial loss reasonably resulting from the withdrawal.
If the vacated place is subsequently filled, this will be taken into account when determining any refund or amount retained.
The Wooden Boat Centre may consider refunds, transfers or other arrangements in exceptional circumstances, including serious illness, injury, bereavement or significant personal emergency.
Nothing in this provision excludes or limits any rights or remedies available under Australian Consumer Law.
special circumstances
We recognise that participants may occasionally be unable to attend because of serious or unexpected circumstances outside their reasonable control.
In cases such as serious illness, injury, bereavement or significant personal emergency, participants may request special consideration.
Depending on the circumstances, The Wooden Boat Centre may offer a refund of some or all course fees paid, transfer the participant to another suitable course, or provide a course credit.
Requests will be considered individually and reasonably. We may ask for reasonable supporting information where appropriate.
transfer to another course or participant
Where sufficient notice is provided, The Wooden Boat Centre may agree to transfer an enrolment to another available course or permit another suitable participant to take the enrolled person's place.
Transfers are subject to course availability and suitability and must be approved by The Wooden Boat Centre in advance.
Cancellation or changes by the wooden boat centre
Occasionally, The Wooden Boat Centre may need to cancel, postpone or reschedule a course because of circumstances such as insufficient enrolments, instructor availability, safety concerns, severe weather or other circumstances outside our reasonable control.
If we cancel a course and cannot provide a suitable alternative, participants will receive a refund of course fees paid, including the deposit.
If a course is postponed or rescheduled, participants will be given the option of transferring their enrolment to the new date. Where the revised date is not reasonably suitable for the participant, we will provide an appropriate refund.
The Wooden Boat Centre is not responsible for participants' external costs associated with attending a course, such as travel or accommodation, except where liability cannot lawfully be excluded.
course requirement and safety
Participants must comply with reasonable safety instructions, workshop procedures and directions given by instructors and staff.
Participants must advise The Wooden Boat Centre before the course of any circumstances that may reasonably affect their ability to participate safely in course activities.
We reserve the right to restrict a participant from undertaking a particular activity where reasonably necessary for their safety or the safety of others.
Serious or repeated unsafe, disruptive, abusive or inappropriate behaviour may result in a participant being asked to leave the course.
australian consumer law
Nothing in these Terms and Conditions excludes, restricts or modifies any rights or remedies that cannot lawfully be excluded under the Australian Consumer Law.
Our services come with consumer guarantees, including that services will be provided with due care and skill and will be reasonably fit for their stated purpose.
Where a participant is entitled to a refund, cancellation or other remedy under Australian Consumer Law, these Terms and Conditions do not limit that entitlement.
Acceptance of Terms
Participants should read these Terms and Conditions before enrolling.
Payment of the enrolment deposit or course fee constitutes acceptance of these Terms and Conditions.
